Safe Harbor 2.0 Negotiations Come Down to the Wire

Last week, United States (US) officials, including Penny Pritzker, Secretary of Commerce, met with European Union (EU) officials from the European Commission at the World Economic Forum in Switzerland to negotiate a data transfer agreement to replace the recently invalidated Safe Harbor agreement.  There is only a week remaining to meet the deadline to form a new agreement.

The US has not publicly disclosed the details of its proposal to the European Commission; however, the EU executive body appears to be pushing for additional standards around oversight, surveillance and transparency. In response to European Commission concerns, the US has provided a seven-point plan for EU citizens to escalate privacy complaints. Further negotiations are expected to play out this week with key EU lawmakers and US regulators weighing in on the issue.
